1. Agreement to Terms
By using the services of Poppin' Parties TX ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
Poppin' Parties TX provides professional party entertainment services across the DFW, Houston, and Austin metro areas. Our services include:
- Face Painting
- Balloon Twisting
- Caricatures (DFW and Austin only)
- Glitter Tattoos
- Live Glitter Fashion Drawings
- Bubble Party
- Combination packages (Best Day Ever, Crazy Fun, Poppin' Party, Giggles & Glitter)
3. Service Area
We are based in Haslet, TX and serve the greater DFW, Houston, and Austin metro areas within an 80-mile service radius. Service availability outside our primary areas may be limited.
4. Bookings and Scheduling
- Bookings can be made through our website contact form, by calling or texting (972) 777-6725, or through our AI booking assistant
- We require accurate event details including date, time, location, expected guest count, and services desired
- Bookings are confirmed once a deposit payment has been received
- We recommend booking at least 48 hours in advance; same-day bookings are subject to artist availability
5. SMS Communications Consent
By providing your phone number during the booking process, you expressly consent to receive SMS text messages from Poppin' Parties TX.
These messages may include:
- Booking confirmations and reminders
- Artist assignment notifications
- Payment links and invoices via Stripe
- Event status updates
- Follow-up communications
Opt-Out: You may opt out at any time by replying STOP to any message or by contacting us directly at (972) 777-6725.
6. Pricing and Payment
- Service pricing is based on the type of entertainment, duration, and package selected
- A non-refundable 30% deposit is required to confirm your booking and reserve your date and time
- The deposit is counted towards the total balance
- Deposits must be made within one day of receiving the booking confirmation — if no deposit is received, Poppin' Parties cannot guarantee that your date and time will remain reserved
- The remaining balance is due 3 days prior to the event date
- For bookings made within 3 days of the event, full payment (100%) is required at the time of booking
- Payment is processed securely through Stripe — we do not collect or store your payment card information
- Payment links are sent via SMS for your convenience
- Travel fees may apply based on event location and will be included in your custom quote
7. Cancellation Policy
In the case that Poppin' Parties must cancel the services, a full refund will be issued for any deposits and payments made by the client.
In the case of cancellation by the client:
Canceling 5 or More Calendar Days Before the Event
- The non-refundable deposit is retained by Poppin' Parties
- A full refund will be issued for any payments made in addition to the deposit amount
Canceling 4 or Fewer Calendar Days Before the Event
- Poppin' Parties will retain 50% of the total booking amount
- A refund will be issued for the remaining 50%
Canceling on the Day of the Event
- Poppin' Parties will retain the full amount — no refunds will be issued
No refunds are issued if the client requested the wrong date or time. No refunds are issued if our artists cannot gain access to the venue or locate the event within 30 minutes of the service start time.
8. Rescheduling Policy
Poppin' Parties offers rescheduling within the next 30 days. Rescheduling requests outside of the 30-day period will be handled under the Cancellation Policy above.
Rescheduling 5 or More Calendar Days Before the Event
- If the new date and time slot is available, the booking will be transferred at no additional charge
- If the requested date and time slot is not available, Poppin' Parties reserves the right to retain the deposit and the booking will be canceled
Rescheduling 4 or Fewer Calendar Days Before the Event
- If the new date and time slot is available, the booking will be transferred with a $50 rescheduling fee
- If the requested date and time slot is not available, Poppin' Parties reserves the right to retain the deposit and the booking will be canceled
Rescheduling on the Day of the Event
- If the new date and time slot is available, the booking will be transferred with a $50 rescheduling fee
- If the requested date and time slot is not available, Poppin' Parties reserves the right to retain 100% of the amount paid
9. Weather Policy
- We strongly encourage clients to have a backup plan in case of unfavorable or extreme weather conditions such as rain, snow, wind, or excessive heat
- No deposits will be refunded in the case of cancellation by the client due to weather conditions
10. Event Requirements
You agree to provide:
- A covered or shaded area for the artist(s) to set up (outdoor events)
- Access to the event location at least 15 minutes before the scheduled start time
- A safe and accessible environment for our performers
It is the event organizer's responsibility to:
- Obtain permission from the parents or legal guardians of children who will receive our services
- Notify our artist(s) about any allergies, sensitive skin, or related conditions prior to the children being painted or serviced
- Supervise children at all times, including while waiting in line for services
- Ensure children do not touch or approach artist equipment and paints
Once the queue has been closed at the end of the booked time, no additional guests will receive services.
11. Artist Assignment
We assign artists based on availability, skill set, location, and event requirements. While we cannot guarantee a specific artist, we ensure all our performers are professional, experienced, and vetted. Some packages require multiple artists — we will coordinate all assignments for your event.
12. Artist Rights
- Artists will not tattoo, draw, or paint without the consent of the person receiving the service
- Artists have the right to refuse to create offensive, violent, or inappropriate content
- Artists have the right to refuse service to any child with restraining medical conditions such as broken skin, open wounds, skin infections, cold symptoms, eye infections, etc.
- Artists have the right to leave the event if they are being physically or verbally abused and/or harassed
- Poppin' Parties reserves the right to cancel a booking at any time — all deposits will be refunded in the case of cancellation by Poppin' Parties
13. Products and Safety
- All products we use are FDA-approved and considered safe for use on skin
- Most face and body painting products are water-based and are easily removed with soap and water
- We use alcohol-based products for specific services such as waterproof face painting — you will be notified about any precautions and possible results before application
- Alcohol-based products can be removed with makeup remover or baby oil
- Some paint may leave a light tint on the skin that should fade within a day
- Some products (including alcohol-based products) can leave stains on cloth, clothing, and objects — Poppin' Parties and its artists are not responsible for any such damage
- All cosmetic products can potentially cause allergic reactions — we accept no liability for reactions when allergies were not disclosed prior to service
14. Liability
- Poppin' Parties and its artists are not responsible for any damage, illness, or injury caused by our services
- Poppin' Parties and its artists are not responsible for the welfare or safety of people or children waiting in line to be painted or serviced
- Poppin' Parties and its artists do not hold any liability for any health or property damage caused by our services
- Our liability is limited to the cost of the service performed
- We are not liable for any consequential or incidental damages
15. Photography and Media
Poppin' Parties and its artists reserve the right to take pictures and videos of their work for advertising and promotional purposes only. Photos will be taken with the children's and their parent's consent. If you prefer no photos be taken, please inform us before the event.
16. AI-Assisted Services
We may use AI-powered voice and text assistants to assist with booking inquiries, scheduling, and customer support. These automated systems are designed to provide accurate information about our services. For complex inquiries, you will always be able to reach a human representative.
17. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be handled in accordance with Texas state law.
18. Modifications
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website.
19. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas.
